These terms and conditions, as well as any contractual or non-contractual relationship arising from the use of the Imkan platform (IMKAN.TOURS) or services provided through it, are subject to and interpreted in accordance with the laws of the Kingdom of Bahrain.
Users, service providers, and the platform agree that the exclusive jurisdiction for hearing any dispute, claim, or disagreement arising from these terms or the use of the platform shall be the courts of the Kingdom of Bahrain, to the extent permitted by mandatory consumer protection laws.
By explicit written agreement between the concerned parties, commercial arbitration may be resorted to as an alternative to litigation before the courts, provided that the arbitration body, its rules, location, and language are determined by such agreement, and the language of arbitration shall be English unless otherwise agreed.
Information related to service providers and travel experiences (including prices, availability, cancellation policies, internal rules, and sustainability procedures) depends on what service providers themselves provide, and they alone are responsible for its accuracy and updating.
The platform operates as a technical intermediary that enables service providers to display their services and enables users to search, compare, and book, and is not a party to any contract concluded between the user and the service provider.
Upon completion of the booking, the platform shares the necessary booking details with the user and service provider in accordance with the adopted privacy policy.
The platform may assist – where possible and in accordance with the service provider's policies – in facilitating change or cancellation requests, without assuming any direct legal obligation to implement them.
The user is obligated to enter correct and updated contact information to ensure communication when needed regarding the booking.
The user is obligated to preserve the property belonging to the service provider and immediately notify them of any damage or loss in accordance with the rules applicable to the provider.
Making the platform available from multiple countries does not create subjection to the laws of those countries, and using the platform constitutes explicit acceptance of the application of the laws of the Kingdom of Bahrain and the jurisdiction of its courts, without prejudice to mandatory consumer rights established under applicable laws.
